Compliance of the Animal Pain Group to the privacy and data protection governance program.
1. WHO WE ARE
The Animal Pain Group originated from the project called “Pain and Quality of Life in Animals”, developed at the Faculty of Veterinary Medicine and Animal Science (FMVZ) of Unesp, Botucatu (SP) campus, led by Professor Stelio Pacca Loureiro Luna, and his research group and collaborators, with support from ZOETIS, FAPESP, CAPES, CNPq, Instituto Bioethicus, and Instituto Anima. The content of the site is the author’s responsibility and does not necessarily reflect the views of the aforementioned institutions.
Our aim is to identify pain in animals using valid and reliable pain scales to inform the need for analgesic treatment and alleviate animal suffering, intended for you, the user (holder), for validation and provision of the necessary information for this purpose.
The Animal Pain Group collects your personal data in accordance with this Privacy Notice and in compliance with relevant data protection legislation, in particular the Brazilian Law No. 13.709/2018, of the General Personal Data Protection Act (LGPD).
When referring to personal data, we understand any data relating to the identified or identifiable natural person, including identification numbers, location data, or electronic identifiers, when these relate to a natural person. In summary, any personal information that can identify its owner.
The protection of privacy and personal data reflects the values of the Animal Pain Group, and this Privacy Notice aims to affirm the group’s commitment to security and transparency in the treatment of these data, as provided for in the personal data protection laws in force.
This Notice provides the necessary information about your rights and obligations and explains how, why, and when we process your personal data.
2. DATA COLLECTED
On our website, we are responsible for processing your personal information to comply with our legal and contractual obligations, as well as to provide you with the proper quality and safety of our products and services.
It is important to point out that we will not collect unnecessary personal data from any owner or user of the website and we will not process your information in any way other than those specified in this Notice.
The Animal Pain Group collects data from users located in other countries, but the storage takes place in Brazil, on the Hostinger Brasil platform, which hosts this website, complying with all regulatory purposes, provided for in Article 33 and items, of Law n. 13,709/2018, of the Brazilian General Data Protection Law, which allows this type of capture.
WHICH PERSONAL DATA ARE COLLECTED
As the purpose of the website is to offer a score of pain scales in animals so that professionals (veterinarians, veterinary nurses, and veterinary assistants), as well as owners and handlers, can measure the animal’s current condition, we capture the following data:
1. Name;
2. E-mail;
3. Sex;
4. Date of birth;
5. Occupation (Veterinarian, Veterinary Student, Veterinary Nurse, Veterinary Assistant, or Animal Owner/Caretaker);
6. Location;
7. Information on the animal.
2.2 HOW WE COLLECT DATA
We collect the information actively entered by the user (holder) on the website when filling out forms on the animal pain diagnosis page, to access the pain score provided by the form.
We also collect your name and email data when you access the “contact us” function.
3. HOW WE USE YOUR PERSONAL DATA
We take your privacy, as well as the security and protection of your data, very seriously and we will never disclose and/or share your data without your consent, other than those already provided, unless required to do so by law.
We keep your data for the period necessary for us to achieve the purpose specified in this Notice.
If you have consented to use our services, you can revoke this consent at any time.
4. PURPOSES AND REASONS FOR THE PROCESSING OF YOUR PERSONAL DATA
We collect your personal data on the website if you choose to fill in the form for the research project on pain and quality of life in animals. The purpose of these forms is to identify pain in animals through valid and reliable pain scales, to inform about the need for analgesic treatment and to minimize animal suffering. We collect and use some of your personal data in order to enable the provision of services and improve the user experience.
5. YOUR RIGHTS
You have the right to access any personal information that we hold about you, and you can also request information about:
1. What personal data we have about you;
2. The purposes of data treatment;
3. The categories of personal data in question;
4. Recipients to whom personal data have been/will be disclosed;
5. How long do we intend to store your personal data;
6. If we do not collect the data directly from you, information about the source.
If you believe that we have any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information and we will endeavor to do so as soon as possible, unless there is a valid reason for not doing so. If the latter situation occurs, you will be duly notified.
You also have the right to request the deletion of your personal data or to restrict processing (where applicable) in accordance with data protection legislation, as well as the right to object to any direct marketing.
Legitimate requests will be dealt with within a period of 15 (fifteen) calendar days. Eventually, a longer period may be necessary, if the request(s) are complex and/or numerous. In this case, we will inform you and keep you updated on the progress of your request(s).
Where applicable, you have the right to data portability of your information and the right to be informed of any automated decision-making that we may use.
If we receive a request from you to exercise any of the above rights, we may ask you to confirm your identity before we act on your request. This confirmation is necessary for us to ensure that your data are protected, preserving your privacy and maintaining security.
6. SHARING AND DISCLOSURE OF YOUR PERSONAL INFORMATION
Please be advised that we do not share or disclose any of your personal data without your consent, except for the purposes specified in this Notice or where there is a legal requirement.
The website uses collaborators to provide the services available. Please note that all operators acting on our behalf only process your data in accordance with our instructions and fully comply with this Privacy Notice, as well as data protection legislation, especially the LGPD (Lei Geral de Proteção de Dados) or General Data Protection Regulation – GDPR (EU) or any other that is applied to the specific case and any other appropriate confidentiality and security measures.
7. USE OF COOKIES
Cookies are small text files sent by the website to the user’s computer, they store information related to website navigation.
Through cookies, small amounts of information are stored by the user’s browser so that our server can retrieve it later. For example, data about the device used by the user, as well as their location and time of access to the website, may be stored, to assist in searches and improve your browsing experience as a data holder.
It should be noted that not every cookie contains the user’s personal data. Certain types of cookies may only be used for the service offered by this website to function correctly. The information eventually stored in cookies is also considered personal data and all the rules provided for in the Privacy Policy are also applicable to them.
8. SAFEGUARD MEASURES
We take your privacy and the security of your data seriously and take all reasonable steps and precautions to protect your personal data.
We work ethically and transparently to protect your personal data from unauthorized access, accidental or unlawful alteration, disclosure, or destruction of your personal data.
9. HOW LONG DO WE KEEP YOUR DATA
We keep your personal data only for as long as is necessary for our purposes to be achieved and we have strict review and retention policies in place to fulfill these obligations.
We will keep the personal data of the user (holder), of the website (animalpain.org) only for as long as is necessary to comply with the purposes for which we collected them, including for the purpose of complying with any legal, contractual, accountability, or request from competent authorities, not exceeding a period of five years.
We are also required by Brazilian legislation (art. 15, of Law 12.965/2014) to keep your basic personal data (name, address, contact details) for a minimum period of 6 (six) months, in case of need for research, these data may be stored on our server until their purpose is achieved, in view of the treatment hypotheses established in article 7, item IV of Law n. 13.709/2018, after which your data will be deleted.
10. RIGHT TO MAKE A COMPLAINT TO THE CONTROL AUTHORITY
The Animal Pain Group only processes your personal data in accordance with this Privacy Notice and in accordance with relevant data protection legislation, especially the LGPD (Lei Geral de Proteção de Dados) or General Data Protection Regulation – GDPR (EU).
If, however, you wish to make a complaint about our processing activities in relation to your personal data, or you are dissatisfied with the way we handle your information, you have the right to file a complaint with the responsible supervisory authority, identified below.
11. COMMUNICATION CHANNEL

You also have the right to submit a request to the National Data Protection Authority (“ANPD”), by direct contact on the website: gov.br/anpd/pt-br.
The purpose of the email address contato@animalpain.org is to establish a channel for contacting the Data Protection Officer (DPO) and for exercising the rights of holders of personal data processed by Animal Pain Group.

12. GLOSSARY
For the purposes of conceptualizing the terms used in Law no. 13.709/2018, which provides for the General Data Protection Law, the following are considered:
Consent: free, informed and unequivocal expression by which the data subject authorizes the processing of their personal data for a specific purpose.
Personal Data: information relating to an identified or identifiable natural person.
Sensitive Personal Data: personal data on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or organization of a religious, philosophical or political nature, data relating to health or sex life, genetic or biometric data, when linked to a natural person.
Data Protection Officer (DPO): the person appointed by the Controller to be responsible for ensuring compliance with the rights of the holders and to clarify doubts about the treatment of their personal data.
Purpose: purpose or objective for achieving the processing of personal data.
Third Party: refers to, but is not limited to, any and all natural or legal persons with whom the Controller relates or will relate, service provider, supplier, consultant, customer, business partner, contracted or subcontracted third party, tenant, transferee of commercial space, regardless of a formal agreement or not, including one who uses the Company’s name for any purpose or provides services, provides materials, interacts with government officials, the government or other third parties on behalf of the controller.
Holder: natural person to whom the personal data being processed refers, such as customers, employees, contractors, and partners.
Data Processing: any operation carried out with personal data, such as those referring to collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, diffusion or extraction.
